New trial: Katherine Jackson, shown in June in Las Vegas, has filed
court documents seeking a new trial against concert promoters AEG Live
after losing her wrongful death lawsuit in October
The 83-year-old matriarch filed
court documents at Los Angeles County Superior Court on Monday, asking for
another chance to convince a jury that AEG should be found liable.
A Los Angeles jury in October
cleared AEG Live of negligence in the singer's 2009 death following a lengthy
trial.
Katherine had accused the concert
promoters of being negligent for hiring her son's personal physician, Dr.
Conrad Murray.
Murray was convicted of involuntary
manslaughter for giving the King of Pop a fatal overdose of the anesthetic
propofol in 2009.
The jury
found that AEG Live, while promoting the singer's This Is It comeback concert,
was not liable for Murray's actions.
Close family: Michael Jackson and his mother are shown in May 2005 at
the singer's child molestation trial in Santa Maria, California
They found that Murray was neither 'unfit' nor 'incompetent' when he was hired by AEG.
The Jackson family last month filed
an appeal challenging a judge's decision to dismiss two AEG defendants early in
the case, CEO Randy Phillips and concert tour producer Paul Gongaware.
But the most recent filing claims
the Jackson family did not have fair proceedings at the trial and asks for a
second chance to convince a jury, according to TMZ.
Jackson children: Michael's children Prince, Paris and Blanket, shown in
2012 in Los Angeles, stand to gain millions of dollars if AEG Live is
found responsible
A judge has not yet ruled on the
family's request.
In her first trial, Katherine was
seeking hundreds of millions of dollars in damages for herself and her late
son's three children, Prince, Paris and Blanket.
Murray was released from jail in
October after he served less than two years of a four-year sentence for
involuntary manslaughter.
Family attorney: Jackson family lawyer Brian Panish, shown in September
in Los Angeles, took on AEG Live in the long case but failed to convince
a jury
