Now the woman who tried to sneak the youngster on board back to her home could be facing up to six years in jail for false imprisonment.
Natasha Vitoriano Souto was stopped as she boarded the bus for 550-mile journey from Rio de Janeiro back to her house in south Brazil after fellow passengers claimed to see a hand poking out of her luggage.
When police opened the suitcase, the boy instantly jumped out to the amazement of officers.
Souto, 23, told police the boy had begged her to adopt him, as his mother was a drug addict and he had been abused.
The child has since been taken into care.
In a statement, The Civil Police said no charges had yet been brought against Souto.
But if she is found guilty of false imprisonment of a child, she could face between two to six years in jail.
